1. Scope

These Terms and Conditions (“T&C”) apply to all contracts, services, and consultations provided through Your Baby’s Rhythm, operated by Kyra Martin, Turnerweg 25, Münchsmünster, Germany, VAT ID: DE320289775. By booking a consultation, purchasing a service, or using this website, you agree to be bound by these terms.

2. Services

• Your Baby’s Rhythm provides sleep consulting, coaching, and guidance for parents and caregivers.

• All services are advisory in nature. Implementation of any recommendations is solely at the discretion and responsibility of the parent(s) or legal guardian(s).

• We do not provide medical treatment or replace medical advice. If you have any concerns about your child’s health, please consult a qualified physician or pediatrician.

3. Client Responsibilities

By engaging our services, you agree to:

• Follow safe sleep practices in line with current recommendations (e.g., AAP Safe Sleep, Deutsches Kinderschutzbund).

• Disclose any medical conditions affecting your child that may impact sleep training.

• Consult your pediatrician before implementing sleep guidance if health concerns exist.

• Understand that you remain fully responsible for your child’s safety, wellbeing, and care.

4. Liability

1. General Limitation

   • Your Baby’s Rhythm provides non-medical consulting services intended to support parents and caregivers with information, coaching, and guidance.

   • All implementation of advice is voluntary and at the sole responsibility of the parent(s) or legal guardian(s).

   • The company and its consultants shall not be held liable for any direct, indirect, or consequential damages, injuries, or losses arising from the application of recommendations, unless otherwise required by law.

2. Exclusion of Medical Liability

   • We are not medical professionals and do not diagnose, treat, or prescribe.

   • Any concerns regarding your child’s health must be directed to a licensed pediatrician or healthcare provider.

   • Our advice does not replace medical examinations or treatment.

3. Scope of Liability

   • Liability of Your Baby’s Rhythm, its owners, and consultants is limited to cases of intentional misconduct or gross negligence.

   • In cases of ordinary negligence, liability is limited to foreseeable and typical damages arising from essential contractual obligations (Kardinalpflichten).

   • Liability for loss of profit, loss of data, or indirect damages is excluded, as far as legally permitted.

4. Non-Transfer of Responsibility

   • Parents/guardians remain fully responsible for the safety, supervision, and wellbeing of their child at all times.

   • Safe sleep practices must be observed in line with official recommendations (e.g., AAP Safe Sleep Guidelines, Deutsche Gesellschaft für Kinder- und Jugendmedizin).

   • Any decision to alter a child’s sleeping or feeding arrangements is made solely by the parent/guardian and at their own risk.

5. Legal Limitations

   • Nothing in these Terms excludes or limits liability where such limitation is not permitted under German law, including but not limited to:

     • Liability for death or personal injury caused by negligence,

     • Liability for fraudulent misrepresentation,

     • Liability under the Produkthaftungsgesetz (German Product Liability Act),

     • Mandatory statutory consumer rights.

5. Intellectual Property

• All sleep plans, guides, and materials provided are copyright protected and intended for the individual client only.

• Sharing, reproducing, or distributing such materials to third parties without written consent is prohibited.

• Violation may result in a claim for damages equivalent to the program’s cost or more under copyright law.

6. Cancellations and Refunds

• Cancellations made more than 48 hours before a scheduled consultation: refund minus a 20% admin fee (covering transaction fees, preparation time, and processing).

• Cancellations within 48 hours: 50% refund only.

• No refund for missed appointments without prior notice.

• If we must cancel a session, you will be offered a full refund or rescheduling.

7. Travel Costs (for In-Person Consultations in Germany)

• The first 20 km of travel are free of charge.

• Thereafter, €0.95 per km is charged, round trip unless agreed upon otherwise.

8. Use of Case Studies

• Information from consultations may be used anonymously for research, training, or marketing purposes.

• No identifying personal data will be published (in line with GDPR/DSGVO).

9. Website Use

• Use of this website is at your own risk. While we strive to provide accurate, up-to-date content, we do not guarantee completeness or correctness.

• Links to third-party sites are provided for convenience. We accept no responsibility for their content.

10. Consumer Rights (Widerrufsrecht)

• Under EU law, you have the right to cancel your booking within 14 days of purchase without providing reasons.

• To exercise this right, you must notify us in writing (e.g., by email).

• If the service has already been fully performed (e.g., a consultation already took place), your right of withdrawal expires.

11. Governing Law and Jurisdiction

• These Terms are governed by German law.

• The place of jurisdiction for disputes is 85126, Münchsmünster, unless mandatory consumer protection law provides otherwise.
